Let us help take the confusion out of workers' compensation.
McMannus Law wants to educate you, while also providing the opportunity for legal services. Until you have signed on the dotted (or solid) line, we are not providing legal advice, but rather giving you information to help decide if you need legal representation. All answers in the Frequently Asked Questions section are intended as informational only and should not be considered legal advice.
On occasion, we offer group educational sessions to provide the public with information they otherwise might not have access to about the workers' compensation system and how it works (or doesn't work, as the case may be.) We fit them in at times that work for you...like after 5, or on a Saturday. Look here for the date of our next session.
Q: How long do I have to report a work related injury to my employer?
A: If your injury was prior to January 1, 2020, but after January 1, 2013, you only had 30 days to provide notice to your employer of your injury. If your injury was on or after January 1, 2020, then you have 60 days to provide notice to your employer.
Notice must be given to a supervisor, owner or other person who has been designated to receive notice. If you are not sure who that is, there should be a Workers' Compensation poster hanging somewhere on your employer's premises that identifies that person.
Q: I didn't hurt myself on a particular day, but the work I do has started to cause me pain over time. Do I have a work related injury?
A: It's very possible that you do. These are called gradual injuries and they often occur as the result of repetitive work. You still need to provide notice to your employer once you believe your condition is work related.
Q: What does workers' compensation cover?
A: Workers' compensation insurance pays for medical treatment and lost time that occurs as a result of a work related injury. Unlike other types of injury claims, workers' compensation does not pay for pain and suffering or making you "whole." Instead, it is designed to provide assistance while you are recovering from your work related injury.
